Our homes at Reunion West POA are subject to recorded Covenants Conditions & Restrictions (CC&Rs).  Our CC&Rs address temporary structures.  How can I get a copy of our CC&Rs?

Article X, Section 13 of our CC&Rs provide the following:

TEMPORARY STRUCTURES.  No tent, shack or other temporary building or Improvement, other than separate construction and sales trailers to be used by Declarant, its agents and contractors, for the construction, service and sale of Reunion West or other communities, shall be placed on any portion of the Committed Property, either temporarily or permanently.  No trailer, motor home or recreational vehicle shall be: (a) used as a residence, either temporarily or permanently, or (b) parked upon the Committed Property.”

Based on our CC&Rs, temporary structures such as bouncy houses, pavilions used for parties, sheds, tents, etc. are NOT permitted at Reunion West POA.  See the following article specifically addressing tents: Are tents allowed on the property?

What about Sukkah which is a temporary structure that you may see erected primarily on driveways during certain religious holidays observed by members and friends of the Jewish faith?  Click on this link for more information about Sukkahs

The Reunion West POA sought legal guidance about Sukkahs in 2023.  The view of our Reunion West POA lawyers is that erection of a Sukkah on a temporary basis is a protected activity under the Fair Housing Act (reasonable accommodation under the Fair Housing Act due to religious practice).   However, these temporary structures must still follow other applicable CC&Rs and not create an unsafe environment.  For example, electricity provided to a Sukkah must be done safely and without violating the Reunion West CC&Rs and local/state laws.
